FlySafair has reviewed the recent decision by the International Air Services Council (IASC) regarding its ownership structure and remains committed to full compliance with all applicable South African laws and regulations. We understand the importance of transparency, foreign involvement limitations, and the role of responsible corporate governance in building trust with our valued customers, partners, regulators, and the public.
The IASC has concluded that FlySafair’s shareholding structure, particularly regarding the involvement of Irish-based ASL Aviation Holdings, is not compliant with the regulation surrounding foreign control limitations. The matter relates to the companies ownership and investment structures and remains three tiers removed from the company’s daily operations.
On the basis of senior legal support, FlySafair has argued that the company’s structure remains within the bounds of both the letter and spirit of the law, and relevant court rulings pertaining to this regulation. We affirm that our intention is, and has always been, to be complaint with prevailing regulation.
